New Hanover County local regulations regarding Accessory Dwelling Units (ADUs) can evolve frequently, impacting setback requirements, permit processes, and rental restrictions. We have compiled a short list of important regulations below.

  • ADU Size.

    An ADU shall be no more than 50% the size of the main dwelling, not to exceed 1,200 square feet.

  • Location.

    An ADU must match the main homes side set backs with a minimum of 5 feet from property line. It can be minimum of 5 feet from the back property line. ADU’s must be 10 feet from other structures. An ADU must sit behind the front facade of the main dwelling.

  • Lot Size.

    There are no restrictions on lot size for ADU’s.

  • Zoning.

    Accessory Dwelling Units are permitted by right in all residential zoning districts except AR (airport) and R-20S.

  • Parking.

    ADU’s must have access to park within the main dwellings driveway and also have one street parking.

  • Number of Units.

    You may only have 1 ADU per property.
