ADU Regulations For New Hanover County & the City of Wilmington
New Hanover County and City of Wilmington ADU regulations frequently change, affecting setbacks, permits, and rental restrictions. Size
ADU heated space shall be no more than 50% the of the main dwelling
ADU heated space cannot exceed 1,200 sqft.
ADU cannot exceed the height of the main dwelling
Zoning
ADU's are permitted by right in all residential zoning districts (except AR and R-20S)
ADU's are not permitted on properties when a mobile home or a manufactured home is the main dwelling
There are no restrictions on lot size for ADU's
Only 1 ADU is allowed per property
A maximum of 2 Accessory Structures are allowed on a property - an ADU counts as 1 of these
Parking
ADU's must have access to park in the main dwellings driveway
ADU's must have 1 street parking available
Setbacks
ADU must match the main dwellings side setbacks
ADU is allowed 5' from the side property line
ADU has a minimum rear setback of 5 feet
ADU must be a minimum of 10' from the main dwelling and other accessory structures
ADU cannot be in front of main dwelling
Exemption: ADU can be in front of the house if it is constructed over a detached garage
Attached ADU's must match main dwelling setbacks
